Terms and Conditions (T&C)

1. Scope and Definitions

These Terms and Conditions (T&C) govern the use of the website www.diwa-soul.com as well as the booking and provision of services, courses, bundles, digital content, free content, and private events. By using the website and booking services, the client agrees to these terms.

Definitions:

• Single Appointments: Booking of a single, time-limited session for an individual. Only one session is scheduled per booking.

• Courses: Group courses conducted over several weeks. Each participant may receive a printed workbook, which is shipped prior to the course (shipping address required). Course dates are listed in advance. Individual final sessions or personal appointments within the course are scheduled individually, depending on the provider’s availability. Weekly group sessions are held online. Participants are responsible for completing the workbook between sessions.

• Bundles: Grouped services offered at discounted rates.

• Private Events: Individually commissioned events/services.

• Zoom Services: Online services delivered via the Zoom platform.

• Digital Content / Free Content: Online content such as audio, video, or text materials, meditations, or inspirations, available for download or streaming.

2. Booking and Payment

Single Appointments, Bundles, and Courses:

• Bookings are made via the website.

• For bundles and courses, only the first session is confirmed; subsequent sessions may differ in day and time.

• Payments are made in advance via Stripe. Upon request, payment via PayPal or bank transfer can be arranged via email.

Courses:

• Full payment is generally required.

• Early bookings may allow installment payments (arranged individually via email).

• The printed workbook is shipped after full payment to the provided shipping address.

Private Events:

• Booking is confirmed upon receipt of a 25% deposit within 14 days of sending the offer.

• Remaining payment is due at least 30 days prior to the event.

Default:

• Reminder fee: €5 per reminder.

• Default interest: 5% above the base interest rate from the 30th day after due date (§ 288 BGB).

• In case of non-payment, the provider reserves the right to cancel the booking unilaterally; incurred costs will be charged.

3. Cancellations

Single Appointments, Bundles:

• Up to 48 hours before the appointment: full refund.

• Later cancellations: no refund; replacement appointment possible subject to availability.

Courses:

• Up to 14 days before the course: free cancellation, full refund.

• Late cancellations (<14 days): 50% refund if the course spot can be reallocated; otherwise no refund.

• During the course: no refund of already paid fees. Replacement sessions for missed weekly group sessions are not guaranteed; final sessions/individual appointments may be rescheduled depending on the provider’s availability.

• Responsibility: participants complete the workbook independently between weekly sessions.

Private Events:

• Up to 14 days before the event: incurred costs are charged.

• Within 14 days: no refund; replacement session within 3 months possible if scheduling permits.

• Cancellation by the provider (not due to client default): full refund; replacement session possible.

4. Technical Requirements and Zoom Use

• Clients are responsible for providing technical equipment (computer, tablet, smartphone, internet).

• Punctual attendance is required; delays up to 10 minutes are tolerated. Afterward, the session ends without refund.

• The provider is not liable for technical issues caused by the client.

• In case of technical issues on the provider’s side, a replacement session will be offered.

5. Group Events

• Individual participant requests cannot be accommodated.

• The provider strives for a harmonious group dynamic; no guarantee.

6. Card Readings, Digital Content, and Free Content

• Card readings are provided as a private YouTube link, not live.

• Link is provided within 7 business days after booking.

• Clients are responsible for accessing the link; links may be time-limited.

• Claims to reissued or altered recordings exist only in case of technical errors on the provider’s side.

• Digital content / free content may be provided for download or streaming; clients agree to the method of provision.

7. Right of Withdrawal

• Withdrawal is possible within 14 days of contract conclusion, provided the service has not yet been rendered.

• Written notice via email: diwa-soul@web.de or by post: Cornelia März, Roßstraße 36, 47918 Tönisvorst.

• After service provision or commencement of the service, the right of withdrawal expires.

8. Purchase of Products During Online Sessions

• Products are shipped after payment.

• Payment via bank transfer or PayPal; shipping/customs fees borne by the client.

• For sales via Etsy, Etsy terms and conditions apply.

9. Disclaimer

• Services serve spiritual and personal development.

• They do not replace medical, psychological, or legal advice.

• The provider is not liable for direct or indirect damages arising from the use of services, including card readings, digital content, free content, or courses.

10. Data Protection

• Data processing in accordance with the privacy policy.

• Use of third-party providers may involve data transfer; security is ensured by data processing agreements.

• Use of social media platforms linked from the website may involve transfer of personal data to third parties. The provider assumes no liability for privacy practices of these platforms.

11. Changes to T&C

• The provider reserves the right to change the T&C at any time; the current version is available on the website.

12. Force Majeure

• Natural disasters, war, pandemics, etc., entitle the provider to postpone or cancel appointments/events without liability.

• Replacement sessions or refunds will be offered.

13. Jurisdiction, Dispute Resolution, and OS Platform

• Disputes will initially be attempted to resolve through mediation or alternative dispute resolution.

• If no agreement is reached, the court of jurisdiction is the provider’s place of business.

• Online dispute resolution (ODR platform): https://ec.europa.eu/consumers/odr. The provider is willing to participate in dispute resolution but is not obliged.

14. Prohibition of Recording and Distribution

• Recording during online sessions is prohibited.

• Video files are for personal use only.

• Reproduction, distribution, or commercial use without consent is prohibited; violations may have legal consequences.
